The trial of Richard Allen, the man accused of the Delphi Murders, has now been delayed until October.  The trial was originally scheduled to get started next week but after a contentious hearing yesterday, things once again took a dramatic swing after the legal team for Richard Allen filed a motion to rescind it's request for a speedy trial.  

A motion to rescind a request for a speedy trial is a formal request made by one of the parties involved in a legal proceeding to withdraw their previous request for a speedy trial. When a defendant requests a speedy trial, they are asking for their case to be heard quickly, usually within a certain timeframe as mandated by law. However, there may be instances where circumstances change, and it becomes beneficial for the defendant to have more time to prepare their case or negotiate a plea deal.

By filing a motion to rescind the request for a speedy trial, the defendant is essentially asking the court to allow them more time before their trial proceeds. This could be for various reasons, such as needing additional time to gather evidence, secure witnesses, or consult with their legal counsel.

The effect of such a motion depends on the decision of the court. If the court grants the motion, it means that the request for a speedy trial is withdrawn, and the trial may be rescheduled to a later date, allowing both parties more time to prepare. However, if the court denies the motion, the trial will proceed as originally scheduled, and the defendant will not have the benefit of additional time.

Ultimately, the decision to grant or deny a motion to rescind a request for a speedy trial rests with the judge overseeing the case, and it will be based on the circumstances presented by the parties involved and as we saw with Judge Gull's ruling.
